Former presidential candidate and National Unity Platform principal Hon. Robert Kyagulanyi Sentamu’s lawyer Medard Lubega Ssegona formally lodged an application to withdraw his election petition against president elect Yoweri Kaguta Tibuhaburwa Museveni.
Kyagulanyi claims he would not get substantive justice as he is being suffocated by the court which has on two occasions disallowed his applications to amend and file fresh evidence in the petition.
Kyagulanyi notes that the fact that government authorities like NIRA security agencies used the advantage to abduct, torture and harrass his witnesses , security agencies sealed off his offices and his illegal house detention made him loss time .
He concludes by asking court to permit him withdraw the entire petition from his own will and not influenced by any corrupt bargain from the respondents.
“ Ssegona says, he received instructions from Kyagulanyi to file an application seeking leave to withdraw the petition and the Application has been filed this morning.”
Segona says he notified the attorney general on the same issue and thus didn’t attend the pre-trial scheduling meeting.
Chief Justice Alfonse Owinyi Dollo says “the petitioner has exercised his right within the law to withdraw his petition.”
However, on reading the rules governing withdrawal of a presidential election petition, a petitioner and his advocate swear supporting affidavits .
But Kyagulanyi’s lawyer Medard Ssegona has not sworn an affidavit but promises to do that by closure of business today.
Meanwhile the rules governing withdrawal of a presidential election petition , Permit Hon. Kyagulanyi to appoint any other candidate who participated in the election to replace him.
